Due to information security and privacy legislation (REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, in short AVG or GDPR)), we would like to inform you about the processing operations we carry out on your personal data, and the policies we take to protect them.

Law firm Nir Zeltzer - Orechdin (hereinafter ORECHDIN) is the data controller in the collection and use of your personal data.

ORECHDIN is a civil company in the form of a private limited liability company, registered in the KBO under number 0879.210.671, RPR Antwerp, with its registered office in 2018 Antwerp, Lange Herentalsestraat 122.

Data processed by ORECHDIN

ORECHDIN processes your personal data because you use our legal services and/or because you have provided it to us yourself.

Below is an overview of the personal data that ORECHDIN (may) process:

  • First name and surname

  • Gender

  • Date of birth

  • Place of birth

  • Address details

  • Telephone and/or mobile number

  • E-mail address

  • Bank account number

  • Company number

  • VAT number

  • Documents required under anti-money laundering legislation (e.g. copy of your identity card)

  • Application forms

Special and/or sensitive personal data

ORECHDIN (may) process the following special and/or sensitive personal data about you:

  • Criminal history, facts or convictions

  • Data of persons under 16 years of age

ORECHDIN does not intend to collect data on clients who are under 16 years of age unless ORECHDIN has parental or guardian consent or in case of absolute necessity to protect the rights of these minor clients.

For what purposes are your personal data used

In any event, ORECHDIN limits the use of your personal data to what is necessary to fulfil our obligations. For example, we may use your personal data for the following purposes, among others:

  • Providing legal advice and/or other services requested by you

  • Processing requests for information

  • Complying with legal requirements

  • Communication with clients

  • Billing data

  • Processing your application

Legal basis(s) for processing your personal data

ORECHDIN processes your personal data on the basis of Article 6.1 of the General Data Protection Regulation (GDG) or General Data Protection Regulation (GDPR):

  • With the consent of the client

  • For the performance of the assignment given by the client and thus for the execution of the agreement concluded with the client

  • To comply with a legal obligation, including in the context of litigation

  • To protect the vital interests of clients or third parties involved

  • When ORECHDIN has a legitimate interest to do so in the context of a law firm's professional activity

How long will we keep your personal data

In principle, ORECHDIN retains your personal data for the period necessary to comply with legal requirements i.e. by law for a period of 5 years after the termination of the agreement between the client and ORECHDIN.

With whom your personal data are shared

ORECHDIN shares your personal data with third parties only if necessary for the performance of our legal obligations or the agreement with you (i.e. with courts and tribunals, bailiffs, notaries, other lawyers, accountants,...).

ORECHDIN may share your personal data with third parties providing services on our behalf. These third parties only have access to your personal data to the extent necessary for their services and to the extent necessary for the performance of the agreement with you.

ORECHDIN will make every effort to ensure that these third parties respect our privacy standards at all times, as well as data protection laws and regulations.

ORECHDIN does not transfer your personal data outside the EEA subject to international filings.

What are your rights regarding your personal data

  • You may invoke the following rights at any time:

  • Right to information: you may ask what data about you is processed and who has access to it, why ORECHDIN needs or uses that personal data and how long it is kept.

  • Right to inspect: you may inspect the data that ORECHDIN holds about you and obtain a copy of your personal data at any time.

  • Right of rectification: if you find errors in your data, you may ask for them to be rectified. You may also add additions to your data.

  • Right to data erasure: you may request that data, which are not (no longer) strictly necessary for ORECHDIN, be permanently and completely deleted.

  • Right to restriction of processing: if you object (see below) to the processing of certain data, you can ask for this processing to stop.

  • Right to data portability: you may ask for the personal data in our possession to be sent to yourself or another organisation named by you

  • Right to object: if you do not agree with the basis of a processing operation or with the way certain data about you are processed, you may object.

  • Right to withdraw his/her consent: if you have been asked for consent for certain processing operations, you may choose at any time to stop providing it.

Any requests for access, rectification, deletion, data transfer or requests to withdraw your consent or object to the processing of your personal data as well as complaints or queries may be addressed to ORECHDIN via e-mail to dj@orechdin.be.

ORECHDIN will investigate your requests, complaints or questions and reply to you in a timely manner.

How do we protect your personal data

ORECHDIN is fully committed to protecting your personal data by taking appropriate organisational and technical measures against misuse, loss, unauthorised access, unwanted disclosure or unauthorised modification.

Direct marketing

Given the lawyer's professional secrecy, there is no such processing of clients' personal data.
